These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the pmdocks.ca website (“Website” or “Service”) and any of its related project estimate portals, image submission feeds, or technical resource descriptions (collectively, “Services”). This Agreement is legally binding between you (“User”, “Client”, “you” or “your”) and PM Docks (“the Company”, “we”, “us” or “our”).

If you are entering into this Agreement on behalf of a commercial enterprise, resort, marina network, or other corporate legal entity, you represent that you possess the explicit authority to bind such entity to these parameters. By accessing and navigating the Website, you acknowledge that you have read, understood, and agree to be bound by this contract.

1. Marine Estimation Framework and Invoicing Boundaries

PM Docks does not process direct digital payments or automated e-commerce retail checkout transactions through this Website. Any technical pricing guidelines, sample calculations, or product variations displayed on the platform are provided strictly for general discovery and convenience purposes.

The submission of an online estimate form or the digital transmission of shoreline imagery does not constitute a binding offer to sell or a locked-in project timeline. A formal contractual relationship is only initiated once a customized, project-specific contract and dedicated Statement of Work are reviewed, accepted, and signed by an authorized representative of PM Docks outside of this Website.

2. Technical Content, Spec Drawings, and Illustrative Dimensions

Any framing schematics, sample cross-sections, floatation calculations, structural layouts, or project galleries hosted on this Website are presented strictly for general illustrative and educational baseline purposes.

They do not constitute certified engineering blueprints or ready-to-build site plans for your specific waterfront environment. Clients must rely exclusively on the formal, stamped engineering documents and structural layout files appended to their individual, signed construction contracts.

3. Property Owner Permitting and Regulatory Compliance Obligations

Waterfront development and marine installations in Ontario are strictly governed by municipal zoning bylaws, regional conservation authorities, the Ontario Public Lands Act, and federal environmental regulations.

Your navigation of this Website or submission of a quote request does not transfer any permitting, environmental scoping, or regulatory filing duties to the Company. Property owners are entirely and exclusively responsible for verifying, securing, and maintaining all necessary government permissions, shoreline work permits, and environmental clearances required for a dock setup at their physical coordinates.

4. Prohibited Uses of the Platform

In addition to other boundaries established throughout this Agreement, you are explicitly prohibited from using the Website, its intake channels, or its content:

(a) for any fraudulent, unlawful, or unauthorized commercial positioning;

(b) to harvest, crawl, or scrape our technical text, case layouts, or proprietary project imagery using automated spiders, data extraction bots, or scrapers;

(c) to transmit viruses, malware, or malicious server-level scripts;

(d) to submit false, misleading, or fraudulent property metrics through our estimation pipelines;

(e) to interfere with or circumvent the operational firewalls and server controls of our performance hosting infrastructure.

5. Corporate Intellectual Property Rights

This Agreement does not transfer any corporate or third-party intellectual property to you. All rights, titles, and interests in the underlying website code, design architecture, portfolio layouts, custom CSS styling frameworks, technical descriptions, and original copy remain exclusively with PM Docks. Your navigation of this platform grants you no license to duplicate or mimic our corporate intellectual property.

6. Third-Party Technical Resource Links

Our Website may link to external technical resources, material suppliers, local conservation authority portals, or regional weather tracking systems. We do not evaluate, warrant, or assume any legal liability for the operational status, terms, or data safety practices of those independent third-party platforms. Your navigation to off-site technical links is executed strictly at your own risk.

7. Disclaimer of Website Warranty

You agree that your navigation of our digital informational platform is executed strictly at your own risk. The Service is provided entirely on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express or implied. We make no warranty that this digital portal will be completely uninterrupted, error-free, or that performance optimization metrics or layout illustrations will translate identically to your independent waterfront property without custom site engineering.

8. Limitation of Website Liability

To the maximum extent permitted by applicable Ontario law, in no event will PM Docks, its partners, directors, officers, corporate employees, or field operators be held liable to any individual or entity for any indirect, incidental, special, punitive, or consequential damages (including, without limitation, lost property value, business interruption, project delivery delays, or lost business revenue) under any theory of liability resulting from your use of this informational platform. Our aggregate corporate liability relating directly to website navigation or electronic intake submission is limited strictly to ten Canadian dollars ($10.00 CAD).

9. Indemnification

You agree to indemnify and hold PM Docks and its directors, officers, employees, and agents harmless from and against any third-party claims, liabilities, losses, damages, or legal costs (including reasonable attorneys’ fees) arising out of or relating to your misuse of this Website, your violation of these terms, or any willful misconduct on your part.

10. Severability and Assignment

If any provision of this Agreement is held to be invalid or unenforceable by an Ontario court of competent jurisdiction, the remaining clauses will continue in full force and effect. You may not assign or transfer your administrative rights under this contract; the Company remains free to assign its obligations as part of a corporate restructuring, merger, or asset transition.

11. Governing Law and Dispute Resolution

The formation, interpretation, and performance of this Agreement shall be governed strictly by the substantive and procedural laws of Ontario, Canada, without regard to conflicts of law. You submit to the exclusive personal jurisdiction of the courts located in Ontario, Canada, for any proceedings arising out of this contract.

12. Changes and Amendments

We reserve the right to modify this Agreement at any time at our discretion to match updates in provincial tracking or technical field configurations. When modifications are posted, we will update the timestamp at the top of this document. Continued navigation of the platform implies consent to those adjustments.

13. Acceptance of These Terms

By exploring pmdocks.ca, utilizing our project discovery forms, or submitting technical property metadata to our team, you acknowledge that you have read this agreement and agree to be bound by its parameters.
